Montinz Terms of Service

By downloading, installing, or using the Montinz mobile application (“App”) or accessing any Montinz website (“Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App or Site.

These Terms constitute a legally binding agreement between you (“User”, “you”) and Montinz (“Company”, “we”, “us”, “our”).

Montinz is an AI-powered wardrobe management and personal styling application. The Service allows users to:

• Photograph and catalogue clothing items using AI-assisted image processing
• Receive AI-generated daily outfit suggestions
• Track outfit history and wardrobe usage
• Manage a personal digital wardrobe

Features are provided “as is” and may change over time. We reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

You must be at least 13 years of age to use Montinz. If you are under 18, you must have parental or guardian consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at joseph@montinz.com if you suspect unauthorised access.

We reserve the right to terminate or suspend accounts that violate these Terms, engage in fraudulent behaviour, or are inactive for extended periods.

“User Content” refers to all photographs, images, clothing data, and other information you upload to the App.

You retain ownership of your User Content. By uploading content to Montinz, you grant us a limited, non-exclusive, royalty-free, worldwide licence to store, process, and display your content solely for the purpose of providing the Service to you.

We do not sell your personal wardrobe data or images to third parties. Your clothing photographs are used only to power your personal experience within the App.

You represent and warrant that:

• You own or have the right to upload all content you submit
• Your content does not infringe any third-party intellectual property rights
• Your content does not contain any illegal material

We reserve the right to remove content that violates these Terms.

Montinz uses machine learning models to process clothing images, identify item types, remove backgrounds, and generate outfit suggestions. You understand and acknowledge that:

• AI-generated outfit suggestions are recommendations only, not guarantees
• Image processing results may not always be accurate
• The quality of suggestions improves with more wardrobe data uploaded
• We continuously improve our AI models, which may change how your data is processed

You agree not to:

• Use the App for any unlawful purpose or in violation of any laws
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Upload content that is obscene, hateful, or violates the rights of others
• Use automated scripts, bots, or scrapers to access the App
• Attempt to gain unauthorised access to our systems or other users' data
• Resell or sublicence access to the Service
• Use the Service to develop a competing product

The Montinz name, logo, App design, algorithms, and all software are the exclusive property of the Company. Nothing in these Terms grants you ownership of any Montinz intellectual property. All rights not expressly granted are reserved.

Montinz is offered as a paid subscription with a 4-day free trial. There is no free plan; if you do not cancel before the trial ends, your subscription begins and you will be charged. Paid subscriptions are billed through the Apple App Store or Google Play, in accordance with Apple's and Google's respective payment terms. We do not process payment information directly.

Refunds are subject to the refund policy of the store you purchased through — Apple's for App Store purchases and Google's for Google Play purchases. We reserve the right to change subscription pricing at any time. You will be notified of price changes before they affect your subscription.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTINZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless Montinz and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

You may delete your account at any time from within the App. Upon deletion, your data will be removed from our systems within 30 days, subject to legal retention obligations.

We may terminate or suspend your access at any time for any reason, including violations of these Terms.

These Terms are governed by the laws of the jurisdiction in which Montinz is incorporated. Disputes will be resolved through binding arbitration or in courts of competent jurisdiction, as applicable.

We may update these Terms at any time. We will notify you of material changes via the App or email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
